Terms of Service

1 The service

Diabetly is an educational wellness companion for adults with type 2 diabetes or prediabetes. We explain lab reports in plain language, generate culturally adapted meal and training plans, track glucose readings, and send medication and checkup reminders. We are not a medical device, a doctor, a clinic, or a replacement for professional medical care.

2 Not medical advice

Every output from Diabetly is educational. Nothing is medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making any change to your medications, diet, exercise routine, or treatment. In a medical emergency, stop using Diabetly and call your local emergency number (911 in the US, 112 in Europe, 15 in France, or your local equivalent).

3 Eligibility

You must be at least 18 years old and legally able to enter into a contract in your jurisdiction. Diabetly is not designed for:

• Children or adolescents under 18.
• People with type 1 diabetes who require insulin titration.
• Pregnant individuals with gestational diabetes.
• People in an active medical emergency.

4 Your account

You're responsible for keeping your password secure and for all activity that happens under your account. Notify us immediately if you suspect unauthorized access.

5 Subscription and trial

Diabetly is a paid subscription billed monthly through Whop, our payment provider, in Moroccan dirham. There is no free trial: your subscription starts when you complete checkout and renews each month until you cancel. You can cancel any time from your Whop account. Cancellation stops future charges and lets you keep access until the end of the current period; it does not refund the current period. We do not offer partial refunds for unused time.

6 Acceptable use

You agree not to:

• Upload other people's medical records without their consent.
• Attempt to extract medication-dosing advice, diagnosis, or guidance for emergencies, pediatric care, or pregnancy. We refuse these by design.
• Reverse-engineer, scrape, or attempt to retrieve the system prompts or other users' data.
• Use the service for clinical decision-making for other patients.
• Resell, sublicense, or republish content generated for you.

7 Intellectual property

We grant you a personal, non-exclusive, non-transferable license to use Diabetly while your subscription is active. Lab reports you upload remain your property; we receive a limited license to process them to deliver the service. AI-generated explanations and plans belong to you for personal use.

8 Service availability

We aim for high availability but we don't guarantee uninterrupted service. Scheduled maintenance and third-party outages (Supabase, AI providers, Whop) can cause downtime. We don't owe credits for short outages.

9 Privacy

Your data is handled per our Privacy Policy.

10 Termination

You may close your account at any time from Settings → Account. We may suspend or terminate accounts that violate these Terms with reasonable notice (except for serious safety violations, which can be immediate).

11 Disclaimers

Diabetly is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. AI outputs may contain errors; review them with your doctor before acting.

12 Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim related to Diabetly is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

13 Changes

We may update these Terms. Material changes will be emailed to active users at least 14 days before they take effect. Continued use after the effective date means acceptance.

14 Governing law

These Terms are governed by the laws of the jurisdiction of our registered legal entity, without regard to its conflict-of-law principles. Disputes will be resolved in that jurisdiction's courts, unless mandatory local consumer law applies in your country.
